Oil + Gas Update | TSAs Rejected in Bankruptcy.


The NYMEX and Henry Hub fell slightly but natural gas spot prices in Appalachia plummeted dramatically since our last report amidst mild Fall weather. In pipeline news, MVP and ETP announce in-service dates for their respective pipeline projects. In court news, a bankruptcy judge in Delaware blessed a motion to reject transportation agreements, Sunoco's trespass claim against an outspoken, contemptuous landowner in Pennsylvania survived a motion, and frac-sand hauling companies recovered for unpaid services in the Marcellus.

  • Leidy South - Benton Loop Expansion (PA): DEP issued notice in the Pennsylvania Bulletin of the right to appeal the Section 401 certification under the Clean Water Act for the Leidy South Natural Gas Pipeline expansion project.


  • Mariner East (Western PA to Eastern PA): Energy Transfer LP said it plans to finish work on Mariner East 2X NGL pipeline in Pennsylvania by the end of the year and the final phase of the Mariner East I and II projects in the second quarter of 2021.


  • Mountaineer XPress (WV): Nothing new to report.


  • Mountain Valley Pipeline (Northern WV to Southern Va. and NC): MVP pushed back the start date for the pipeline until later in 2021 amidst additional legal challenges.MVP has experienced years of delay and costs are projected to reach $5.8-$6 billion, nearly $3 billion over original estimates.

  • Transportation Service Agreements can be Rejected under Section 365. A bankruptcy judge in Delaware concluded that transportation services agreements into which debtors entered with midstream companies to transport production at rates approved by FERC can be rejected in bankruptcy. In re: Extraction Oil & Gas, --- B.R. ---, No. 20-11548 (CSS), 2020 WL 6389252 (Bankr. D. Del. Nov. 2, 2020).


  • Protestor Faces Sunoco’s Trespass Claims. A federal judge knocked out all of Sunoco’s claims except for trespass alleged against an outspoken protester of the Mariner East pipelines who previously violated court orders preventing her from entering Sunoco’s property, holding that she again violated an order enjoining her from entering Sunoco’s property such that her actions constituted trespass. Gerhart v. Energy Transfer Partners, L.P., --- F. Supp. ---, No. 1:17-CV-01726, 2020 WL 6487484 (M.D. Pa. Nov. 4, 2020).

  • TX Appellate Court Upholds Multi-Million Jury Verdict for Unpaid Frac Sand Hauling Services. A Texas court of appeals upheld a $3 million verdict in favor of trucking companies whose oilfield services customers failed to pay for sand-hauling services in the Marcellus except to the extent the companies claimed quantum meruit since their contract governed their right to recovery.
